BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Subchapter C, Chapter 382, Health and Safety
Code, is amended by adding Section 382.0651 to read as follows:
Sec. 382.0651.  LOCATION AND OPERATION OF CERTAIN CONCRETE
BATCH PLANTS.  (a)  In this section, "concrete batch plant" means a
concrete plant that performs wet batching, dry batching, or central
(b)  The commission by rule shall prohibit the operation of a
concrete batch plant operating under a standard permit issued under
Section 382.05195 within 550 feet of a concrete crushing facility,
a hot mix asphalt plant, or a second concrete batch plant operating
under that standard permit, unless the first concrete batch plant
was authorized to begin operations before September 1, 2025.
(c)  This subsection applies only to the renewal of an
authorization to use a standard permit issued under Section
382.05195 for a concrete batch plant that was authorized to begin
operations before September 1, 2025.  After the renewal of the
authorization, the commission shall prohibit the operation of the
concrete batch plant at the same time as any of the following types
of facilities located within 550 feet of the concrete batch plant:
(1)  a concrete crushing facility;
(2)  a hot mix asphalt plant; or
(3)  another concrete batch plant operating under a
standard permit issued under Section 382.05195.
(d)  The measurement of distance for the purposes of this
section must be taken from the point on the concrete batch plant
that is nearest to the concrete crushing facility, hot mix asphalt
plant, or other concrete batch plant toward the point on the
concrete crushing facility, hot mix asphalt plant, or other
concrete batch plant that is nearest the concrete batch plant.
SECTION 2.  This Act takes effect September 1, 2025.
