relating to a Texas Department of Criminal Justice record of
information regarding death penalty drugs.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Chapter 493, Government Code, is amended by
adding Section 493.036 to read as follows:
Sec. 493.036.  RECORD OF DEATH PENALTY DRUGS.  (a)  The
department shall adopt a policy to track the department's inventory
of drugs for the execution of inmates receiving the death penalty.
The policy must require the department to maintain a record that
includes with respect to each drug, the name of the drug, the date
received by the department, the expiration date, and, if
applicable, the date used by the department in an execution.
(b)  For a drug for which the expiration date is extended
after receipt by the department, the record under this section must
include the original expiration date, the date and results of
applicable testing, and the new expiration date.
(c)  Not later than December 1 of each year, the department
shall submit a report containing the information maintained under
this section to the governor, the lieutenant governor, the speaker
of the house of representatives, and each standing committee of the
legislature with primary jurisdiction over the department.
SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2025.
