relating to compliance reviews and life safety code surveys of BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. The heading to Section 247.0261, Health and Safety Code, is amended to read as follows: Sec. 247.0261. [EARLY] COMPLIANCE REVIEW REQUIRED BEFORE SECTION 2. Section 247.0261(a), Health and Safety Code, is (a) The executive commissioner by rule shall adopt a procedure under which a person who constructs or modifies an assisted living facility or proposes [proposing] to construct or modify an assisted living facility may submit building plans to the department for review for compliance with the department's architectural requirements before completing [beginning] construction or modification. In adopting the procedure, the executive commissioner shall set reasonable deadlines by which the department must complete review of submitted plans. SECTION 3. Subchapter B, Chapter 247, Health and Safety Code, is amended by adding Section 247.02615 to read as follows: Sec. 247.02615. LIFE SAFETY CODE SURVEYS AUTHORIZED BEFORE COMPLETION. A person who constructs or modifies an assisted living facility may request a life safety code survey for the facility before the construction or modification is completed. SECTION 4. As soon as practicable after the effective date of this Act, the executive commissioner of the Health and Human Services Commission shall adopt rules necessary to implement the changes in law made by this Act. SECTION 5. This Act takes effect September 1, 2025.
