What This Bill Does

Protects the confidential financial records of perpetual care cemeteries by preventing their public disclosure, with limited exceptions for state agencies and political subdivisions. Financial information about these cemeteries' condition and trust funds will remain private, unless state officials determine that sharing the information serves the public interest or helps enforce existing laws. The new confidentiality rules will take effect on September 1, 2025.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Subchapter A, Chapter 712, Health and Safety
Code, is amended by adding Section 712.010 to read as follows:
Sec. 712.010.  CONFIDENTIALITY AND DISCLOSURE OF CERTAIN
FINANCIAL INFORMATION.  (a)  Except as provided by Subsection (b),
records or other information retained by the department that relate
to the financial condition of a perpetual care cemetery or
perpetual care trust fund are confidential and not subject to
disclosure under Chapter 552, Government Code.
(b)  The department may disclose records or other
information described by Subsection (a) to this state, a political
subdivision of this state, or an agency of this state if the
department considers disclosure to be in the best interest of the
public or necessary or proper to aid in the enforcement of a law or
