relating to the maintenance of certain improvements associated with oil and gas development and production; authorizing an BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter B, Chapter 91, Natural Resources Code, is amended by adding Section 91.021 to read as follows: Sec. 91.021. MAINTENANCE OF CERTAIN IMPROVEMENTS. (a) An operator of a well drilled for oil or gas shall maintain in accordance with rules adopted by the commission all land and (1) associated with operations incident to oil and gas (2) located between the wellhead and a highway, as defined by Section 366.003, Transportation Code. (b) If the commission determines that a person has violated a rule adopted under this section, the commission shall assess a penalty against the person in the manner provided by Sections 81.0532 through 81.0534 for assessing an administrative penalty SECTION 2. This Act takes effect September 1, 2025.
