relating to the authority of a municipality to authorize the
creation or expansion of a political subdivision in the corporate
boundaries or extraterritorial jurisdiction of the municipality.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Chapter 41, Local Government Code, is amended by
adding Section 41.005 to read as follows:
Sec. 41.005.  CREATION OR EXPANSION OF POLITICAL SUBDIVISION
IN CORPORATE BOUNDARIES.  Notwithstanding any other law, no part of
a political subdivision may be created or expanded in the corporate
boundaries of a municipality unless the governing body of the
municipality by ordinance authorizes the creation or expansion.
SECTION 2.  Subchapter C, Chapter 42, Local Government Code,
is amended by adding Section 42.0423 to read as follows:
Sec. 42.0423.  CREATION OR EXPANSION OF EMERGENCY SERVICES
DISTRICT IN EXTRATERRITORIAL JURISDICTION.  Notwithstanding any
other law, no part of an emergency services district governed by
Chapter 775, Health and Safety Code, may be created or expanded in
the extraterritorial jurisdiction of a municipality unless the
governing body of the municipality by ordinance authorizes the
