What This Bill Does
Prohibits local government entities in Texas from using public funds to provide legal services for individuals who are unlawfully present in the United States during immigration removal proceedings. Political subdivisions are banned from directly funding legal representation or indirectly supporting such legal services through grants or other financial means, unless such representation is constitutionally required. The law will take effect on September 1, 2025, and applies to all local government entities within Texas.

relating to the authority of a political subdivision to use public money to provide legal services in a removal proceeding for an individual unlawfully present in the United States. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 140, Local Government Code, is amended by adding Section 140.014 to read as follows: Sec. 140.014. PROHIBITION ON USE OF PUBLIC MONEY TO PROVIDE CERTAIN LEGAL SERVICES FOR UNLAWFULLY PRESENT INDIVIDUALS. Unless required by the United States Constitution, a political subdivision (1) use public money to provide legal services in a removal proceeding for an individual who is unlawfully present in the United States according to the terms of the federal Immigration and Nationality Act (8 U.S.C. Section 1101 et seq.); or (2) provide public money to a person to be used to directly or indirectly provide legal services in a removal proceeding for an individual described by Subdivision (1). SECTION 2. This Act takes effect September 1, 2025.
