BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Subchapter C, Chapter 42, Human Resources Code,
is amended by adding Section 42.0413 to read as follows:
Sec. 42.0413.  SUBMISSION OF CAPACITY AND ENROLLMENT DATA.
(a)  Each day-care center, group day-care home, and family home
shall submit capacity and enrollment information to the Texas
Workforce Commission and the commission shall include the
information on the commission's child care availability portal to
allow parents to locate day-care centers, group day-care homes, and
family homes in their geographic region that have available
(b)  The information provided under this section must
(1)  information regarding the day-care center's, group
day-care home's, or family home's desired total capacity; and
(2)  the following information disaggregated by age
(A)  the number of children currently enrolled in
(B)  the number of positions the center or home
(c)  Each day-care center, group day-care home, and family
home shall notify the Texas Workforce Commission of any change in
the enrollment information as soon as practicable but not later
than the 30th day after the date of any change in enrollment or
SECTION 2.  As soon as practicable after the effective date
of this Act, the executive commissioner of the Health and Human
Services Commission shall adopt rules necessary to implement
Section 42.0413, Human Resources Code, as added by this Act.
SECTION 3.  This Act takes effect September 1, 2025.
