What This Bill Does

relating to the hours for the sale or delivery of certain alcoholic BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 24.07, Alcoholic Beverage Code, is Sec. 24.07. HOURS OF SALE. A holder of a wine only package store permit may remain open and sell malt beverages, wine, and vinous liquors, for off-premises consumption only, on any day and during the same hours as those prescribed for the sale of malt beverages under Section 105.05[, except that the permittee may not sell wine or vinous liquor containing more than 17 percent alcohol by volume on a Sunday or after 10 p.m. on any day]. SECTION 2. Section 105.01, Alcoholic Beverage Code, is Sec. 105.01. HOURS OF SALE: LIQUOR. [(a)] Except as provided in Sections 105.02, 105.03, 105.04, 105.08, and 105.091, no person may sell, offer for sale, or deliver any liquor: (1) on New Year's Day, Thanksgiving Day, or Christmas (2) outside the hours prescribed for the sale of malt beverages under Section 105.05 [on Sunday; or [(3) before 10 a.m. or after 9 p.m.] on any other day. [(b) When Christmas Day or New Year's Day falls on a Sunday, Subsection (a) of this section applies to the following Monday.] SECTION 3. Section 105.02, Alcoholic Beverage Code, is Sec. 105.02. HOURS OF SALE: WHOLESALERS AND LOCAL DISTRIBUTORS TO RETAILERS. (a) A holder of a wholesaler's permit may sell, offer for sale, or deliver liquor to a retailer anytime except [Sunday and] Christmas Day. (b) A local distributor's permittee may sell, offer for sale, or deliver liquor to a retailer during the hours prescribed for the sale and delivery of malt beverages under Section 105.051 [between 5 a.m. and 9 p.m.] on any day except[: [(3)] a day on which a package store permittee is prohibited from selling liquor. SECTION 4. This Act takes effect September 1, 2025.
