relating to use of compost in landscaping, capital construction,
and road maintenance projects by the Texas Department of
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Subchapter H, Chapter 201, Transportation Code,
is amended by adding Section 201.626 to read as follows:
Sec. 201.626.  USE OF COMPOST.  (a) In this section,
"compost" means the disinfected and stabilized product of the
decomposition process that is used or sold for use as a soil
amendment, artificial top soil, growing medium amendment, or other

a contract for a landscaping, capital construction, or road
maintenance project for which the Texas Department of
Transportation first advertises or otherwise solicits bids,
proposals, offers, or qualifications, or makes a similar
solicitation, on or after the effective date of this Act. A contract
for which the Texas Department of Transportation first advertises
or otherwise solicits bids, proposals, offers, or qualifications,
or makes a similar solicitation, before the effective date of this
Act is governed by the law in effect on the date the advertisement
or solicitation is made, and that law is continued in effect for
SECTION 3.  This Act takes effect September 1, 2025.
