relating to the imposition of a fee for oil and gas waste that is not BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter C, Chapter 27, Water Code, is amended by adding Section 27.0322 to read as follows: Sec. 27.0322. DISPOSAL FEE. (a) For oil and gas waste that is not produced in this state, the commission shall impose a fee of 20 cents per barrel of oil and gas waste. (b) Notwithstanding any other law, contract, or agreement, the cost of a fee imposed under this section may be passed on to the producer of the oil and gas waste if the person required to pay the (c) The fee collected under this section shall be deposited to the credit of the oil and gas regulation and cleanup fund as provided by Section 81.067, Natural Resources Code. (d) The commission may adopt rules necessary to implement SECTION 2. This Act takes effect September 1, 2025.
