relating to the facility or location at which public school prekindergarten classes may be provided in partnership with a BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 29.153, Education Code, is amended by adding Subsection (h) to read as follows: (h) Notwithstanding any other law, a facility or location at which prekindergarten classes are provided by a school district or open-enrollment charter school in partnership with a private entity under this section may not be required to comply with: (1) any municipal ordinance applicable to the operation of a private prekindergarten program other than a municipal ordinance providing a local occupancy restriction; or (2) any municipal ordinance applicable to the operation of a prekindergarten program by a school district or open-enrollment charter school. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2025.
