Bill Text
relating to eligibility for a general permit to discharge waste into or adjacent to waters in this state. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 26.040, Water Code, is amended by adding Subsection (h-1) to read as follows: (h-1) After the commission denies or suspends a discharger's authority to discharge under a general permit under Subsection (h), the commission may not authorize the discharger to discharge under a general permit before the fifth anniversary of the date of the denial or suspension. SECTION 2. Section 26.040(h-1), Water Code, as added by this Act, applies only to a denial or suspension ordered on or after the effective date of this Act. A denial or suspension ordered before the effective date of this Act is governed by the law in effect on the date the denial or suspension is ordered, and that law is continued in effect for that purpose. SECTION 3. This Act takes effect September 1, 2025.
