relating to the inspection of group homes by county fire marshals.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  The heading to Section 352.0165, Local
Government Code, is amended to read as follows:
Sec. 352.0165.  INSPECTION OF GROUP HOMES [IN CERTAIN
SECTION 2.  Section 352.0165(a)(1), Local Government Code,
(1)  "Group home" has the meaning assigned by Section
769.001, Health and Safety Code, as added by Chapter 141 (S.B. 188),
Acts of the 88th Legislature, Regular Session, 2023 [means an
[(A)  in which three or more individuals who are
unrelated to the owner or operator of the establishment reside;
[(B)  that provides residential care services to
[(C)  that receives payment or other compensation
from a local, state, or federal governmental entity for providing
residential care services to a resident].
SECTION 3.  Section 352.0165(b), Local Government Code, is
SECTION 4.  It is the intent of the 89th Legislature, Regular
Session, 2025, that the amendments made by this Act be harmonized
with another Act of the 89th Legislature, Regular Session, 2025,
relating to nonsubstantive additions to and corrections in enacted
SECTION 5.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2025.
