relating to the composition of the Health and Human Services BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Sections 523.0103(a) and (c), Government Code, as effective April 1, 2025, are amended to read as follows: (a) The executive council is composed of: (1) the executive commissioner; (2) the director of each division the executive commissioner established under former Section 531.008(c) before the expiration of that subsection on September 1, 2023; (3) the commissioner of a health and human services (4) the commissioner of the Department of Family and Protective Services, regardless of whether that agency continues as a state agency separate from the commission; [and] (5) at least one parent or guardian of a child with a disability who is a Medicaid recipient, including a recipient of services under a Medicaid waiver program, appointed by the (6) other individuals the executive commissioner appoints as the executive commissioner determines necessary. (c) An executive council member appointed under Subsection (a)(5) or (6) serves at the executive commissioner's pleasure. SECTION 2. Section 523.0107, Government Code, as effective April 1, 2025, is amended to read as follows: Sec. 523.0107. COMPENSATION; REIMBURSEMENT FOR EXPENSES. An executive council member appointed under Section 523.0103(a)(5) or (6) may not receive compensation for service as a council member but is entitled to reimbursement for travel expenses the member incurs while conducting council business as provided by the General Appropriations Act. SECTION 3. As soon as practicable after the effective date of this Act, the executive commissioner of the Health and Human Services Commission shall appoint at least one parent or guardian of a child with a disability to the commission's executive council as required by Section 523.0103(a)(5), Government Code, as amended SECTION 4. This Act takes effect September 1, 2025.
