relating to the prohibition of tolls on portions of State Highway BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. The heading to Subchapter E, Chapter 228, Transportation Code, is amended to read as follows: SUBCHAPTER E. LIMITATION ON TOLL FACILITY DESIGNATION, TOLL COLLECTION, AND [;] CONVERSION OF NONTOLLED STATE HIGHWAY SECTION 2. Subchapter E, Chapter 228, Transportation Code, is amended by adding Section 228.202 to read as follows: Sec. 228.202. TOLLS PROHIBITED ON PORTIONS OF STATE HIGHWAY 146 AND STATE HIGHWAY 99. The department may not charge a toll, either directly or indirectly through an agreement with another (1) the portion of State Highway 146 that crosses the (2) the portion of State Highway 99 between its intersection with State Highway 146 and its crossing of Cedar SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2025.
