relating to the purchase of military service credit in the Employees Retirement System of Texas. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 811.001, Government Code, is amended by adding Subdivisions (16-a), (16-b), and (17-a) to read as follows: (16-a) "State active duty" has the meaning assigned by (16-b) "State training and other duty" has the meaning (17-a) "Texas military forces" has the meaning SECTION 2. Section 813.301(a), Government Code, is amended (a) Military service creditable in the retirement system (1) active federal duty as a member of the armed forces (2) state active duty or state training and other duty as a member of the Texas military forces. SECTION 3. Section 813.304(b), Government Code, is amended (b) The retirement system shall use military service credit in computing service retirement or nonoccupational disability retirement benefits of a member of the employee class, regardless of the amount of service credit the member has in that class [only if the member has, without military service credit, at least five years of service credit in that class]. SECTION 4. Section 820.021, Government Code, is amended to Sec. 820.021. CREDITABLE MILITARY SERVICE; RULES. (a) Military service creditable in the retirement system under this (1) active federal duty as a member of the armed forces (2) state active duty or state training and other duty as a member of the Texas military forces. (b) The board of trustees shall adopt rules to comply with the Uniformed Services Employment and Reemployment Rights Act of 1994 (38 U.S.C. Section 4301 et seq.) and otherwise implement this subchapter, including rules governing how a member subject to this chapter may establish military service credit under this SECTION 5. This Act takes effect September 1, 2025.
