relating to the eligibility of an individual to adopt or foster a
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Section 162.001(a), Family Code, is amended to
(a)  Subject to the requirements for standing to sue in
Chapter 102, only an adult who identifies as the same biological sex
listed on the individual's birth certificate entered at or near the
time of birth or modified only to correct a scrivener or clerical
error in the biological sex may petition to adopt a child who may be
SECTION 2.  Chapter 263, Subchapter A, Family Code is
amended by adding Section 263.0011 to read as follows:
Section 263.0011.  ELIGIBILITY OF AN INDIVIDUAL TO FOSTER A
CHILD.  Only an adult who identifies as the same biological sex
listed on the individual's birth certificate entered at or near the
time of birth or modified only to correct a scrivener or clerical
error in the biological sex is eligible to foster a child.
SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
act takes effect September 1, 2025.
