relating to notice and opportunity for public comment for certain
policies adopted or implemented by a state agency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Subtitle A, Title 10, Government Code, is
amended by adding Chapter 2010 to read as follows:
CHAPTER 2010.  PUBLIC NOTICE AND HEARING FOR CERTAIN AGENCY ACTION
Sec. 2010.001.  APPLICABILITY OF CHAPTER.  This chapter does
not apply to a rule that is subject to the requirements of
Sec. 2010.002.  NOTICE AND OPPORTUNITY FOR PUBLIC COMMENT
FOR CERTAIN POLICIES.  (a)  Before a state agency may implement or
adopt a policy that affects a procedure or agency action relating to
a private person, the state agency must:
(1)  give notice of the agency's intention to adopt the
policy in the same manner that the agency would give notice of the
agency's intent to adopt a rule under Section 2001.023; and
(2)  give all interested persons a reasonable
opportunity for public comment in the same manner that the agency
would give interested persons an opportunity to submit data, views,
or arguments under Section 2001.029(a).
(b)  A state agency shall consider fully all comments the
agency receives about a proposed policy.
SECTION 2.  The changes in law made by this Act apply only to
a policy implemented or adopted on or after the effective date of
SECTION 3.  This Act takes effect September 1, 2025.
