relating to interagency sharing of certain information related to
individuals disenrolled from Medicaid.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Subchapter E, Chapter 532, Government Code, as
effective April 1, 2025, is amended by adding Section 532.0207 to
Sec. 532.0207.  MEMORANDUM OF UNDERSTANDING WITH TEXAS
DEPARTMENT OF INSURANCE FOR PROVISION OF CERTAIN INFORMATION.  (a)
In this section, "department" means the Texas Department of
(b)  The commission shall enter into a memorandum of
understanding with the department for purposes of providing to the
department the name of and contact information for each individual
who is being disenrolled from Medicaid, subject to the individual's
consent, so that the department may conduct outreach efforts to
assist the individual with applying for and obtaining health
(c)  The memorandum of understanding required under
Subsection (b) must require that:
(1)  the commission obtain the written consent of an
individual to provide the individual's information to the
(2)  the information be provided and maintained in a
manner consistent with federal and state privacy laws.
SECTION 2.  If before implementing any provision of this Act
a state agency determines that a waiver or authorization from a
federal agency is necessary for implementation of that provision,
the agency affected by the provision shall request the waiver or
authorization and may delay implementing that provision until the
waiver or authorization is granted.
SECTION 3.  This Act takes effect September 1, 2025.
