relating to the effect of payments made after the deadline for presuit notice in actions against an insurer related to certain BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 542A, Insurance Code, is amended by adding Section 542A.008 to read as follows: Sec. 542A.008. EFFECT OF PAYMENT AFTER NOTICE DEADLINE. Any payment made after the deadline for presuit notice under Section 542A.003 does not limit in any way an insured's right to recover interest, penalties, attorney's fees, or any other noneconomic damages for the claim for which the payment was made. SECTION 2. Section 542A.008, Insurance Code, as added by this Act, applies only to an action that commences on or after the SECTION 3. This Act takes effect September 1, 2025.
