What This Bill Does

Requires operators of motor-assisted scooters to attach a flag to the back of their scooter when riding on streets, highways, sidewalks, or bicycle paths. The Department of Public Safety must establish rules for flag implementation by December 1, 2025, with actual enforcement beginning February 1, 2026. Scooter riders will need to comply with this new visibility requirement to help improve safety for themselves and other road users.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Section 551.352, Transportation Code, is amended
by adding Subsection (f) to read as follows:
(f)  A person operating a motor-assisted scooter on a street,
highway, sidewalk, or bicycle path in accordance with this section
must attach to the back of the scooter a flag, in the manner
SECTION 2.  (a)  Not later than December 1, 2025, the
Department of Public Safety shall adopt rules necessary to
implement Section 551.352(f), Transportation Code, as added by this
(b)  Notwithstanding Section 551.352(f), Transportation
Code, as added by this Act, a person is not required to comply with
the requirements of that subsection until February 1, 2026.
SECTION 3.  This Act takes effect September 1, 2025.
