What This Bill Does

Requires all Texas public schools and charter schools to prominently display both the United States and Texas flags in every classroom where students are assigned, along with the text of the pledges of allegiance to these flags. Schools are not mandated to use district or state funds for these displays but can raise money or accept donations to acquire the required flags and text displays, with implementation set to begin in the 2025-2026 school year.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Section 25.082, Education Code, is amended by
amending Subsection (b-1) and adding Subsection (b-2) to read as
(b-1)  The board of trustees of each school district and the
governing board of each open-enrollment charter school shall
(1)  the United States and Texas flags be prominently
displayed in accordance with 4 U.S.C. Sections 5-10 and Chapter
3100, Government Code, in each campus classroom to which a student
is assigned at the time the pledges of allegiance to those flags are
(2)  the text of the pledges of allegiance to the United
States flag and the Texas flag as provided by 4 U.S.C. Section 4 and
Section 3100.101, Government Code, be prominently displayed in each
(b-2)  A district or school is not required to spend federal,
state, or local district or school funds to acquire flags or
displays required under Subsection (b-1) [this subsection]. A
district or school may raise money or accept gifts, grants, and
donations to acquire flags or displays required under Subsection
SECTION 2.  The change in law made by this Act applies
beginning with the 2025-2026 school year.
SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2025.
