BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 28.0211, Education Code, is amended by adding Subsections (a-15) and (a-16) to read as follows: (a-15) The agency shall approve high impact tutoring providers for purposes of providing accelerated or supplemental instruction under this section. In approving a provider, the (1) whether the provider provides personalized (2) the frequency and consistency of the provider's (3) whether the provider employs qualified and (4) whether the provider provides instruction to students individually or in groups of no more than four students per (5) whether the provider uses data-driven and (a-16) In contracting with a high impact tutoring provider approved by the agency under Subsection (a-15), a school district shall use an outcomes-based contract. The agency shall develop and post on the agency's Internet website a template that districts may use in contracting with a provider under this subsection. The (1) provide for a significant portion of the provider's payment to be contingent on the achievement of specific, (2) allow the district to prioritize certain student (3) align the incentives for the district and the (4) minimize financial risk for the district; (5) ensure that the provider is held accountable for delivering the specific, measurable student outcomes outlined in (6) establish a framework for shared accountability between the district and the provider. SECTION 2. Section 28.0211(a-16), Education Code, as added by this Act, applies only to a contract entered into on or after the SECTION 3. This Act takes effect September 1, 2025.
