What This Bill Does
Allows hydrogen-fueled vehicles in Texas to exceed standard weight limitations by the additional weight of their hydrogen tank and fueling system, compared to a similar diesel tank system. The weight exemption is specifically designed to accommodate the unique infrastructure requirements of hydrogen-powered vehicles. However, the bill will only take effect if federal legislation or regulations are passed that authorize hydrogen vehicles to operate on interstate highways at weights exceeding current federal limitations.

relating to weight limitations for hydrogen-fueled motor vehicles. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 621.101, Transportation Code, is amended by adding Subsection (b-2) to read as follows: (b-2) Notwithstanding any other provision of this section, a vehicle or combination of vehicles that is powered by an engine fueled primarily by hydrogen may exceed any weight limitation under this section by an amount that is equal to the difference between the weight of the vehicle attributable to the hydrogen tank and fueling system carried by that vehicle and the weight of a comparable diesel tank and fueling system, provided that the maximum gross weight of the vehicle or combination of vehicles may SECTION 2. (a) Except as otherwise provided by this section, this Act takes effect September 1, 2025. (b) This Act takes effect only if the United States Congress enacts legislation or a federal agency adopts a regulation that becomes law authorizing a vehicle that is powered by an engine fueled primarily by hydrogen to be operated on a federal interstate or highway at a weight that exceeds a weight limitation established by federal law. If the United States Congress or a federal agency does not enact legislation or adopt a regulation that becomes law described by this subsection, this Act has no effect.
