What This Bill Does
Allows municipalities to create ordinances that enable residents or property owners to file applications to stop nonconforming property uses within their city limits. The legislation provides local governments with additional flexibility to address zoning and property use issues by giving citizens a formal mechanism to challenge uses that do not comply with current zoning regulations. Property owners and residents can now potentially request the cessation of property uses that do not conform to current municipal standards through a formal application process.

relating to the authority of a municipality to allow a person to file an application to stop a nonconforming use of a property. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 211.019, Local Government Code, is amended by adding Subsection (q) to read as follows: (q) This section does not prohibit a municipality from adopting or enforcing an ordinance, regulation, or other measure that allows a person who resides or owns real property in the municipality to file an application to stop a nonconforming use of a SECTION 2. Section 211.019(q), Local Government Code, as added by this Act, applies to an ordinance, regulation, or other measure adopted by a municipality on, before, or after the SECTION 3. This Act takes effect September 1, 2025.
