What This Bill Does

Gives Texas tenants more flexibility in receiving their security deposit refunds by allowing them to choose between a traditional check/money order or a direct credit to the original payment method used to pay the security deposit, such as a credit card or electronic payment. The law provides tenants with additional options for receiving their refunded security deposit, making the return process more convenient and adaptable to modern payment methods. The law will go into effect on September 1, 2025, giving landlords time to update their refund practices.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Section 92.103, Property Code, is amended by
adding Subsection (d) to read as follows:
(d)  The tenant is entitled to receive the refund of a
security deposit in the tenant's choice of:
(1)  a check, money order, or other traceable or
(2)  a credit applied to the form of payment used to pay
the security deposit, including a credit card or other electronic
