What This Bill Does

Increases penalties for towing companies, booting companies, and parking facility owners who intentionally or recklessly violate towing regulations. If found in violation, they can be liable for $1,000 plus three times the original fees, $500 for each day the vehicle owner cannot use their vehicle, and additional incidental costs. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Section 2308.404(c), Occupations Code, is
(c)  A towing company, booting company, or parking facility
owner who intentionally, knowingly, or recklessly violates this
chapter is liable to the owner or operator of the vehicle that is
the subject of the violation for:
(1)  $1,000 plus three times the amount of fees
assessed in the vehicle's removal, towing, storage, or booting;
(2)  $500 for each day the vehicle owner or operator is
unable to use the vehicle because of the violation; and
(3)  reasonable incidental costs incurred by the
vehicle owner or operator resulting from the loss of use of the
SECTION 2.  The change in law made by this Act applies only
to a violation that occurs on or after the effective date of this
Act.  A violation that occurs before the effective date of this Act
is governed by the law in effect on the date the violation occurred,
and the former law is continued in effect for that purpose.
SECTION 3.  This Act takes effect September 1, 2025.
