What This Bill Does

Allows property owners' associations (HOAs) to refuse partial payments from homeowners unless there is a pre-agreed written payment plan. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Chapter 209, Property Code, is amended by adding
Section 209.00635 to read as follows:
Sec. 209.00635.  PARTIAL PAYMENT TO ASSOCIATION.  A property
owners' association is not required to accept partial payment from
an owner of any amount owed to the association, unless the partial
payment is made to the association under a payment plan or other
written agreement the owner enters into with the association under
which the association agrees to accept the partial payment from the
