What This Bill Does
Allows property owners' associations (HOAs) to refuse partial payments from homeowners unless there is a pre-agreed written payment plan. The legislation gives HOAs more discretion in handling outstanding financial obligations from property owners. Effective September 1, 2025, this law provides HOAs with additional flexibility in managing payments and potential debt collection processes.

relating to partial payment by an owner of an amount owed to a BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 209, Property Code, is amended by adding Section 209.00635 to read as follows: Sec. 209.00635. PARTIAL PAYMENT TO ASSOCIATION. A property owners' association is not required to accept partial payment from an owner of any amount owed to the association, unless the partial payment is made to the association under a payment plan or other written agreement the owner enters into with the association under which the association agrees to accept the partial payment from the SECTION 2. This Act takes effect September 1, 2025.
