What This Bill Does

Prohibits non-electric vehicles from parking in electric vehicle charging station spaces, making it a traffic violation. Any vehicle that is not an electric vehicle and not actively charging cannot legally occupy these designated parking spots. The law will go into effect on September 1, 2025, giving businesses and drivers time to understand and comply with the new parking restrictions.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Section 545.302(a), Transportation Code, is
(a)  An operator may not stop, stand, or park a vehicle:
(1)  on the roadway side of a vehicle stopped or parked
at the edge or curb of a street;
(5)  between a safety zone and the adjacent curb or
within 30 feet of a place on the curb immediately opposite the ends
of a safety zone, unless the governing body of a municipality
designates a different length by signs or markings;
(6)  alongside or opposite a street excavation or
obstruction if stopping, standing, or parking the vehicle would
(7)  on a bridge or other elevated structure on a
highway or in a highway tunnel;
(9)  where an official sign prohibits stopping; or
(10)  in a parking space or area that is clearly
designated as an electric vehicle charging station, unless the
vehicle is an electric vehicle, as defined by Section 382.003,
Health and Safety Code, and the operator is charging the vehicle.
SECTION 2.  This Act takes effect September 1, 2025.
