What This Bill Does

Allows school districts to create policies that permit children of foreign military personnel stationed in Texas to enroll in school based on their age by the end of the school year, rather than requiring them to have already reached the standard age requirement at the start of the school year. The policy provides flexibility for military families who may have different educational entry requirements in their home countries or who are temporarily stationed in Texas. The new policy will apply starting in the 2025-2026 school year and gives local school district boards of trustees the discretion to implement this accommodation.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Section 25.001, Education Code, is amended by
adding Subsection (c-3) to read as follows:
(c-3)  Notwithstanding Subsections (a) and (b), the board of
trustees of a school district may adopt a policy to allow a person
whose parent or guardian is an active-duty member of a foreign
military force stationed in this state to establish the person's
age for purposes of determining eligibility under those subsections
by demonstrating that the person will turn the required age during
the school year for which the person is seeking admission.
SECTION 2.  This Act applies beginning with the 2025-2026
SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2025.
