What This Bill Does

Modifies rules for property owners' associations by limiting how long a declarant (original property developer) can control the association's board. After 50% of lots are sold to non-developer owners, at least one board member must be elected by those owners. When 75% of lots are sold, at least one-third of board members must be elected by non-developer owners. If the total number of lots isn't specified in the declaration, one-third of board members must be elected within five years of the declaration's recording. These changes aim to give homeowners more representation and control in their property owners' association governance.
