What This Bill Does

Modifies the rules for removing an area from a municipality's extraterritorial jurisdiction (ETJ), expanding the conditions under which land can be released from municipal control. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.   Section 42.101, Local Government Code, is
amended by amending Subdivisions (1), (4), and (5) and adding
Subdivision (6) to read as follows:
(1)  within [five] fifteen miles of the boundary of a
military base, as defined by Section 43.0117, at which an active
(4)  in an area designated as an industrial district
(5)  in an area subject to a strategic partnership
agreement entered into under Section 43.0751, or any other
agreement, including a development agreement entered into under
(6)  in an area within a municipality’s certificate of
convenience and necessity issued in accordance with Chapter 13,
SECTION 2.  Section 42.151, Local Government Code, is
amended by amending Subdivisions (1), (4), and (5) and adding
Subdivision (6) to read as follows:
(1)  within [five] fifteen miles of the boundary of a
military base, as defined by Section 43.0117, at which an active
(4)  in an area designated as an industrial district
(5)  in an area subject to a strategic partnership
agreement entered into under Section 43.0751, or any other
agreement, including a development agreement entered into under
(6)  in an area within a municipality’s certificate of
convenience and necessity issued in accordance with Chapter 13,
SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2025.
