What This Bill Does
Requires Texas school districts to provide employees with at least two additional days of paid wellness leave per year, separate from existing personal leave. These wellness days cannot be accumulated or deducted from an employee's current leave balance, and districts must create policies for using the leave without requiring employees to provide documentation. The new wellness leave provision will take effect for the 2025-2026 school year, giving school districts time to implement the new policy.

relating to personal leave for wellness provided for school BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 22.003, Education Code, is amended by adding Subsection (a-1) to read as follows: (a-1) In addition to all other days of leave provided under this section or by a school district, a school district employee is entitled to not less than two days of leave for compensation per year for wellness. Days of leave taken under this subsection may not be accumulated or deducted from an employee's accumulated personal leave. A school district shall adopt a policy regarding an employee's use of leave under this subsection, including procedures for the processing and documentation of leave taken under this subsection. A school district may not require documentation from an employee for days of leave taken under this subsection. SECTION 2. This Act applies beginning with the 2025-2026 SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2025.
