What This Bill Does

Requires the ERCOT independent organization to collect and analyze customer response to conservation appeals across different zip codes in the ERCOT power region. Utility companies and electric providers must provide aggregate information to help compile these analyses, while being prohibited from sharing individual customer data or personal information. The organization must publish quarterly online updates and submit an annual legislative report detailing how customers in different areas respond to energy conservation requests.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Subchapter Z, Chapter 39, Utilities Code, is
amended by adding Section 39.920 to read as follows:
Sec. 39.920.  RESPONSE TO CONSERVATION APPEALS.  (a) The
independent organization certified under Section 39.151 for the
ERCOT power region shall collect for each zip code in ERCOT
information showing the response by retail electric customers in
that zip code to conservation appeals issued by the independent
(b)  Notwithstanding any provision in Chapter 17, Section
(1)  the independent organization certified under
Section 39.151 for the ERCOT power region may request that an
electric cooperative, municipally owned utility, retail electric
provider, or transmission and distribution utility provide to the
independent organization information to allow the independent
organization to comply with Subsection (a); and
(2)  in response to a request described by Subdivision
(1), an electric cooperative, municipally owned utility, retail
electric provider, or transmission and distribution utility shall
provide the information to the independent organization.
(c)  An electric cooperative, municipally owned utility,
retail electric provider, or transmission and distribution utility
may not provide individual retail electric customer usage data or
personal information to the independent organization certified
under Section 39.151 for the ERCOT power region in response to a
request received under this section.
(d)  The independent organization certified under Section
39.151 for the ERCOT power region shall:
(1)  at least quarterly publish on the independent
organization's Internet website updated analyses of the response by
retail electric customers in ERCOT to conservation appeals issued
by the independent organization; and
(2)  submit to the legislature an annual report
summarizing the analyses published under Subdivision (1).
SECTION 2.  This Act takes effect September 1, 2025.
