What This Bill Does

Protects property owners' rights to display political signs by limiting property owners' associations' ability to restrict or communicate against such displays. If a sign meets existing legal restrictions, the association cannot send letters, emails, or make oral demands attempting to prevent the sign's display. Property owners who receive such communications can sue the association for injunctive relief and potentially recover attorney's fees if they win the lawsuit.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Section 259.002, Election Code, is amended by
adding Subsection (f) to read as follows:
(f)  Unless a sign described by Subsection (b) is displayed
in violation of a restrictive covenant permitted by this section, a
property owners' association may not issue to the property owner
displaying the sign any communication, including a letter, e-mail,
or oral demand, purporting to restrict the sign's display.  A
property owner who receives a communication from a property owners'
association issued in violation of this subsection may bring an
action for injunctive relief under this subsection to enjoin the
association from engaging in the practice.  The court shall award
reasonable attorney's fees to a property owner who prevails in an
