relating to the notification of a municipality of electric
cooperative requests for the transfer or removal of certain pole
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Section 252.006, Utilities Code, is amended by
adding Subsection (a-1) to read as follows:
(a-1)  Not later than the 10th day after the date the
electric cooperative provides notice to a cable operator under
Subsection (a), the electric cooperative shall provide the
municipality in which the pole is located with notice of the
installation of the new pole.  The notice must state the location of
the pole and describe the transfer procedure for pole attachments.
SECTION 2.  Section 252.007, Utilities Code, is amended by
adding Subsection (a-1) to read as follows:
(a-1)  Not later than the 10th day after the date the
electric cooperative provides a cable operator with a written
request for removal under Subsection (a), the electric cooperative
shall provide the municipality in which the pole is located with
notice of the removal request.  The notice must state the location
of the pole and describe the abandoned attachment.
SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2025.
