relating to a study of electricity demand response. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is amended by adding Section 39.9056 to read as follows: Sec. 39.9056. DEMAND RESPONSE STUDY. (a) In this section, "demand response" means changes in electricity usage by customers from their normal consumption patterns in response to: (1) changes in the price of electricity use over time; (2) incentive payments designed to induce lower electricity use at times of peak demand. (b) The commission shall conduct a study on the potential for expanding demand response programs in this state to encourage retail electric customers to reduce electricity use during times of (c) Not later than December 1, 2026, the commission shall issue a report to the legislature that: (1) reviews the current state of demand response participation in each customer class; (2) identifies potential barriers to the expansion of demand response participation by each customer class; and (3) includes recommendations for any additional legislative authority the commission requires to expand demand response programs in this state. (d) This section expires September 1, 2027. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2025.
