What This Bill Does
Prevents property owners' associations from prohibiting or restricting homeowners from keeping chickens on their property, as long as the local municipal ordinance allows it. relating to the authority of certain property owners' associations to prohibit or restrict the keeping of chickens. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 202.007(a), Property Code, is amended to (a) A property owners' association may not include or enforce a provision in a dedicatory instrument that prohibits or restricts a property owner from: (1) implementing measures promoting solid-waste composting of vegetation, including grass clippings, leaves, or brush, or leaving grass clippings uncollected on grass; (2) installing rain barrels or a rainwater harvesting (3) implementing efficient irrigation systems, including underground drip or other drip systems; [or] (4) using drought-resistant landscaping or water-conserving natural turf; or (5) keeping chickens on the owner's property, if a municipal ordinance authorizes the property owner to keep chickens SECTION 2. This Act takes effect September 1, 2025.
