What This Bill Does
Requires that federal money received for public education can only be used for primary and secondary education purposes in Texas. If the state appropriates more money to school districts through the Foundation School Program than districts are legally entitled to receive, the commissioner must distribute the excess funds equally per student to each school district. relating to the dedication of certain federal money received for public education and the distribution to school districts of certain excess funds appropriated for the Foundation School BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 1, Education Code, is amended by adding Section 1.008 to read as follows: Sec. 1.008. DEDICATION OF FEDERAL MONEY. Money received from the federal government for the purposes of public primary and secondary education may be appropriated only for purposes related to public primary and secondary education in this state. SECTION 2. Subchapter F, Chapter 48, Education Code, is amended by adding Section 48.284 to read as follows: Sec. 48.284. DISTRIBUTION OF EXCESS FUNDS. Notwithstanding any other provision of law, not later than September 1 of any year following a school year in which the commissioner determines that the amount appropriated for purposes of the Foundation School Program exceeded the amount to which school districts were entitled under this chapter, the commissioner shall: (1) notify the Legislative Budget Board of the excess (2) distribute the excess funds, less the amount required to comply with Section 48.265, as determined by the commissioner, to each school district in an equal amount per student in weighted average daily attendance for the previous SECTION 3. This Act takes effect September 1, 2025.
