BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1.  Section 825.4092(e), Government Code, is amended
(e)  The amounts required to be paid under Subsections (b)
and (c) are not required to be paid by a reporting employer for a
retiree who retired from the retirement system:
(1)   before September 1, 2005; or
(2)  on or after September 1, 2005, if:
(A)  the retiree's employment qualifies for an
exception under Section 824.601(b-1) or 824.602(a)(3) to the loss
of benefit payments described by Section 824.601(b); and
(B)  the reporting employer demonstrates to the
Texas Education Agency that the employer cannot through reasonable
efforts fill the position other than with a person working on a
SECTION 2.  The changes in law made by this Act apply to a
retiree of the Teacher Retirement System of Texas regardless of
whether the person retired from employment before, on, or after the
SECTION 3.  The changes in law made by this Act apply
beginning with the 2025-2026 school year.
SECTION 4.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2025.
